Lumian Terms of Use

You must be at least 18 years old and capable of entering into legally binding contracts.

You agree to provide accurate, current, and complete information when creating an account and to maintain the confidentiality of your login credentials.

You are responsible for all activity under your account. Notify Lumian immediately at support@lumian.ai if you suspect unauthorized access.

You may use Lumian's Services solely for legitimate Amazon selling and business purposes in compliance with:

• Amazon's Acceptable Use Policy (AUP) and Developer Agreement
• Applicable data protection laws (e.g., GDPR, CCPA)
• These Terms and Lumian's Privacy and Data Retention Policies

You agree not to:

• Use the Services for unlawful, infringing, or deceptive activities.
• Reverse-engineer, scrape, or attempt to extract data or models from Lumian systems.
• Upload or transmit harmful code, malware, or unauthorized content.
• Misrepresent generated AI content (e.g., listings or images) as verified by Amazon.

Lumian reserves the right to suspend or terminate access for violations of these Terms or applicable law.

The Services may use third-party AI providers (including OpenAI and Anthropic) to generate insights, recommendations, and content.

You retain full responsibility for reviewing and verifying any AI-generated listings, images, or suggestions before submitting them to Amazon.

Lumian makes no guarantees regarding the accuracy, legality, or compliance of AI-generated content with Amazon's policies or local regulations.

By using AI tools, you grant Lumian a limited, revocable license to process and analyze your data solely for delivering the requested outputs.

Lumian's tools operate under the Amazon Services API Developer Agreement.

Your Amazon seller data, including listings, campaign metrics, and business insights, are accessed and processed only for your own account and never shared across users.

Lumian does not aggregate, resell, or disclose Amazon Information except as required for authorized operations.

You authorize Lumian to access and process Amazon data through secure, compliant integrations.

All Lumian software, designs, and underlying technology remain the exclusive property of Lumian.

You may not copy, modify, distribute, or create derivative works from Lumian's Services.

You retain ownership of any product listings, data, or materials you upload.

AI-generated outputs are licensed to you for business use, subject to these Terms and applicable third-party provider restrictions.

Certain features require paid subscriptions or usage-based fees.

All fees are billed according to the plan selected at sign-up and are non-refundable unless otherwise stated.

Lumian may update pricing or plan structures with prior notice. Continued use after notice constitutes acceptance of updated pricing.

Data handling follows Lumian's Privacy Policy and Amazon-compliant Data Retention Policy.

Data is encrypted during transfer and storage.

Amazon Information is retained for limited periods and securely deleted thereafter.

Lumian employs access controls, encryption, and monitoring to safeguard your data.

Lumian strives for high availability but does not guarantee uninterrupted service.

We may modify, suspend, or discontinue Services (or specific features) at any time with reasonable notice where feasible.

Updates and enhancements are provided at Lumian's discretion.

The Services and AI outputs are provided "as is" and "as available" without warranties of any kind.

Lumian disclaims liability for any loss, damage, or penalties arising from reliance on AI-generated outputs, including rejected Amazon listings or policy violations.

You are solely responsible for ensuring that all AI-generated content complies with Amazon's requirements and applicable law.

To the maximum extent permitted by law:

Lumian shall not be liable for indirect, incidental, or consequential damages arising from your use of the Services.

Lumian's total aggregate liability shall not exceed the amount paid by you for Services during the three (3) months preceding the claim.

You may terminate your account at any time by contacting support@lumian.ai.

Lumian may suspend or terminate your access for violation of these Terms, non-payment, or misuse of the Services.

Upon termination, your account data will be handled in accordance with the Data Retention Policy.

Lumian may update these Terms periodically. Changes will be posted on our website with the new effective date. Continued use after updates constitutes acceptance.

These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law principles.

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
